  1. THE ORGANIZER OF THE CAMPAIGN

The organizer of the " Special Price " campaign (hereinafter referred to as the "Campaign") is SC SOFIAMAN IMPEX SRL . (designated in the following under the title "Organizer"), with headquarters in Targu Neamt, str. Marasesti , no. 215 code 615200 , Neamt county, registered at the Trade Register with no. J27/105/1996, C UI EN 4536401 , represented by Mr. Florin Cucu , as General Director.

 

  1. II . AREA OF THE CAMPAIGN

 

The campaign will take place both on www.sofiaman.ro, as well as in all the stores in the network Sofiaman and online on sofiaman .ro, within the limits of available stocks. The promotional campaign will take place during the period  December 1, 2021 – December 31, 2023 in the stores of the Organizer and partners, implicitly for consignments.

 

 

III. THE RIGHT TO PARTICIPATE

Any legal entity and any natural person with a minimum age of 16 years (hereinafter referred to as "Participant") who buys from a store can participate in the Campaign Sofiaman or online from sofiaman.ro

 

  1. CAMPAIGN MECHANISM
  2. The campaign consists of applying discounts up to 70 ( seventy )% on the selling price of those products that are properly marked on the shelf in the stores Sofiaman , through posters .
  3. In the case of the online store sofiaman.ro , products and discounts will be grouped in a separate category called "Special Price", where only the products from this promotion will be found.
  4. Participants will be able to purchase from the stores Sofiaman and online from sofiaman .ro promotional price products, provided they are properly marked in physical stores and/or are strictly part of the "Special Price" category on sofiaman.ro
  5. The campaign is not cumulated with other promotional offers and/or special offers and/or advertising campaigns and/or other price reductions granted by the Organizer, regardless of the method of granting them (including, but not limited to, loyalty card, gift card, other value cards / vouchers related to other advertising campaigns) .
  6. In case of placing an order on sofiaman .ro, the invoice will be issued based on the data provided by the Participant in the process of placing the order.
  7. The Organizer is not responsible and cannot be held responsible for the provision by the Participant of incorrect, incomplete and/or false data when the account is created and/or when the order is placed.
  8. During the Campaign, on sofiaman.ro will be able to be placed orders both by phone and online .
  9. In case of returning a product purchased by using a discount offered in the Campaign, regardless of the reason for the return, the amount refunded will be equal to the amount actually paid by the Participant, i.e. the price of the product on the receipt/invoice for the purchase of the product, minus the value of the discount granted in Campaign.

 

  1. CAMPAIGN REGULATIONS

The Campaign Regulations are available free of charge in all stores in the network Sofiaman and online on sofiaman.ro

 

  1. MAJOR FORCE

 

In any situation of force majeure that prevents or delays, in whole or in part, the execution and/or continuation of the Campaign, the Organizer will be exempt from any responsibility regarding the fulfillment of its obligations for the period in which it will be prevented.

 

ARE YOU COMING. INTERRUPTION, MODIFICATION, SUSPENSION AND TERMINATION OF THE CAMPAIGN

 

The organizer reserves the right to suspend, modify, extend or definitively interrupt the Campaign at any time, but not before informing the public by displaying it in the stores Sofiaman and online on sofiaman.ro .

 

 

VIII. PROTECTION OF PERSONAL DATA

The processing of personal data takes place on the basis of Regulation no. 679 of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, hereinafter referred to as RGPD.

By participating in the Campaign in the stores in the network Sofiaman or online at sofiaman .ro, Participants agree to the processing of personal data for the purpose of offering the products sold by the Organizer. This processing is based on art. 6 para. 1 lit. b (execution of a contract) and letter c (fulfilment of a legal obligation) of the RGPD Regulation.

Campaign participants are guaranteed the rights provided by the RGPD, namely the right to access, to rectify, to delete data, to restrict processing, to data portability, as the case may be, to opposition, the right not to be subject to an individual automated process, including the creation of profiles that concern or affect them in a similar way, to a significant extent, and the right to withdraw their consent if the processing takes place based on it, later, easily and free of charge, the withdrawal only having effects for the future.

Participants have the right to address the court or the National Supervisory Authority ( www.dataprotection.ro ).

 

  1. LEGAL BASIS

This Regulation is in accordance with the provisions of OG no. 99/2000 regarding the sale of market products and services, GD no. 333/2003 including methodological norms for the application of OG no. 99/2000 regarding the marketing of market products and services and Regulation (EU) no. 2016/679 regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

 

 

  1. disputes

 

Any disputes arising between the Organizer and the participants of the promotion will be resolved amicably if _ and where this will not be possible, the disputes will be resolved by the competent Romanian courts in Neamt county.

 

  1. Inquiry

The written request of the Campaign Participants in order to notify the Organizer of non-compliance with these Regulations must be submitted or sent to the Organizer's headquarters within a maximum of 48 (forty-eight) hours from the purchase of the product from one of the stores Sofiaman from the country, respectively from the delivery date for products bought online, from sofiaman .ro. Any notification in this regard submitted after the mentioned deadline will not be able to be resolved positively. Disputes will be resolved within 15 (fifteen) calendar days.

 

XII. OTHER REGULATIONS

In case of attempted fraud, abuse or acts directed against and/or at its address, the Organizer reserves the right to take all the necessary measures to remedy the situation and hold the guilty parties accountable under the law.

The Organizer does not assume responsibility for the impossibility of participating in the Campaign due to errors or causes that do not directly depend on the Organizer, such as technical failures of the Internet service provider, etc.

 

XIII. MISCELLANEOUS

 

Participation in this campaign implies acceptance of these Regulations.
